Terms of Service

1. Who we are

PhemeClip is a software service published by LEVEL96, a French société par actions simplifiée (SAS), SIREN 938 960 028, 10 Parc Club du Millénaire, 1025 avenue Henri Becquerel, 34000 Montpellier, France ("PhemeClip", "we"). Contact: [email protected].

2. The service

PhemeClip turns long-form videos you provide into short-form assets: transcripts, clip suggestions, rendered 9:16 videos, carousels, captions and packaging material. Outputs are generated automatically, partly with AI models; you review them before publishing anywhere.

3. Accounts

You need an account with a verified email address. You are responsible for your credentials and for activity under your account. Accounts are for businesses and professionals aged 18 or over.

4. Plans, credits and payment

Paid plans are billed in euros, exclusive of VAT, monthly or yearly, through our payment provider Stripe. Each plan grants a monthly credit allowance; actions (analysis, rendering, packaging) consume credits at the rates displayed in the app. Unused monthly credits do not roll over; purchased credit packs remain usable for 12 months.

Subscriptions renew automatically until cancelled. You can cancel at any time from Billing → Manage subscription; the plan stays active until the end of the paid period. Statutory withdrawal: by starting to use the service (spending credits) before the end of the 14-day withdrawal period, you request immediate performance and acknowledge losing the right of withdrawal for the service already performed, per articles L.221-25 and L.221-28 of the French Consumer Code.

5. Your content

You keep all rights to the videos you upload and to the outputs generated from them. You grant us the technical licence needed to host, process and deliver them back to you. You warrant that you own or control the rights to the source material and that it is lawful.

Source files and outputs are retained for the period stated by your plan, then deleted. Deleting a video or your account deletes the associated files.

6. Acceptable use

No unlawful, infringing or deceptive content; no attempts to probe, overload or reverse-engineer the service; no reselling of the service as-is. We may suspend accounts that break these rules, with notice where practicable.

7. Availability and support

The service is provided on a reasonable-efforts basis, without a contractual SLA. Planned maintenance and third-party incidents (hosting, model providers, payment) can interrupt it. Support: [email protected].

8. Liability

To the extent permitted by law, our total liability for any claim related to the service is capped at the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect damages, loss of profits or loss of audience. Nothing limits liability that cannot be limited under French law.

9. Changes

We may update these terms; material changes are announced by email or in-app at least 15 days before they apply. Continued use after that date is acceptance. Prices of running subscriptions only change at renewal, with prior notice.

10. Law and jurisdiction

These terms are governed by French law. Consumers benefit from mandatory protections of their country of residence. For professionals, the courts of Montpellier, France have exclusive jurisdiction after an attempt at amicable resolution.
